GENERAL TERMS OF BUSINESS AND USE OF THE PLETIX d.o.o. WEBSHOP

1. GENERAL PROVISIONS

1.1. The company Pletix d.o.o. provides an online service through its website on the domain Pletix.hr, on the World Wide Web. The service consists of providing information services, content management, and conducting financial transactions.
1.2. Within the Pletix d.o.o. website, Pletix d.o.o. offers a service of trade representation in the legal sale of goods between users of the Pletix d.o.o. Internet service, namely the Seller and the Buyer, and organizes the transport of the items being sold.

2. LIABILITY OF THE PLETIX D.O.O. WEBSHOP

2.1. The user accepts these General Terms of Business and Use, as well as the Privacy Policy of the Pletix d.o.o. webshop, upon special registration on the Pletix d.o.o. webshop electronically, which is a prerequisite for participation on the Pletix d.o.o. webshop. During this process, the user voluntarily provides personal data, which Pletix d.o.o. will handle in accordance with the Privacy Policy published on the Pletix d.o.o. website. Pletix d.o.o. invites the user to read these General Terms of Business and the Privacy Policy, as these rules will apply to the use of Pletix d.o.o. webshop services and in the event of any misunderstanding.
2.2. Users of the services provided by the Pletix d.o.o. webshop are considered to be registered users and buyers who have placed an order through the Pletix.hr webshop.
2.3. The user explicitly agrees that Pletix d.o.o. cannot be held responsible for the behavior of users of the services and that the risk of possible damage is entirely borne by the users of the services, in accordance with the applicable laws of the Republic of Croatia.
2.4. Pletix d.o.o. is not responsible for any temporary unavailability of the PLETIX.hr website or any of its platforms, nor for any partial or total interruption of operation or malfunction.
2.5. The PLETIX.hr website may be temporarily unavailable or available in a limited capacity due to regular system maintenance, system upgrades, or force majeure.
2.6. The Pletix d.o.o. webshop reserves the right to change, cancel (temporarily or permanently) any element, service provided, content, or entry without prior approval or notice, in accordance with good business practices.
2.7. Pletix d.o.o. is not responsible for technical issues that may cause delays and/or incorrect processing of electronic data. For any questions not regulated by specific terms of use of the Pletix d.o.o. webshop, the General Terms of Business and the applicable legislation of the Republic of Croatia, as well as other relevant international regulations, apply.
2.8. Pletix d.o.o. does not guarantee the accuracy, reliability, or content provided by users. Texts, comments, photos, and other entries that users leave in the designated sections must be accurate and correct. Users who enter the data are responsible for the accuracy of the data provided. The accuracy of the entries implies that they come from a competent source and/or the user’s personal experience. Each user is solely responsible for the accuracy of the data they enter.
2.9. The Pletix d.o.o. website complies with social rules and laws during its operation. A user who notices a problem, violation, unacceptable content, etc., is obliged to report it to Pletix d.o.o. at the email address webshop@pletix.hr.
2.10. The Pletix d.o.o. webshop is not responsible if the data, images, and other elements of the website infringe on anyone’s intellectual or copyright. If you believe that your right or the right of a third party has been violated, please notify Pletix d.o.o. at the email address webshop@pletix.hr.
2.11. The PLETIX D.O.O. webshop reserves the right to cancel unconfirmed user accounts or accounts that have been inactive for a long period, as well as to remove ads that are considered unacceptable for publication by Pletix d.o.o. or according to legal criteria.
2.12. Relations on the Pletix d.o.o. webshop occur between the Seller and the Buyer (registered users of the Pletix.hr website of the Pletix d.o.o. webshop) with the trade representation of Pletix d.o.o. through the Pletix d.o.o. website. The Seller and Buyer can be legal or natural persons. Issuing invoices or concluding a Sales Agreement obligates the Seller in accordance with the law and is not the responsibility of the trade representative.
2.13. If a relationship arises between the Seller and the Buyer, which is recorded on the Pletix d.o.o. website, Pletix d.o.o., as the trade representative, will fulfill its obligations under the contract and these General Terms of Business.
2.14. Product photos are for illustrative purposes only and may not always and in all details correspond to the actual products. Given the possibility of individual monitor settings, differences in color perception by the human eye, and similar factors, we cannot guarantee that the colors of our products will completely match the colors as users see them on their monitor screens.

3. AUTHORITIES OF THE PLETIX D.O.O. WEBSHOP

3.1. Pletix d.o.o. is not obliged to check or in any way control the behavior of Pletix d.o.o. webshop users, but it can do so if deemed necessary.
3.2. By establishing membership, users agree that the consequences defined in these General Terms of Business will apply to them, in accordance with the rules of these General Terms of Business.
3.2.1. The Pletix d.o.o. webshop reserves the right to delete offers, text, images, or any other material from the Pletix d.o.o. webshop at any time without special explanation. This applies particularly, but not exclusively, to offers placed in an inappropriate market category, offers with unusually low prices, offers that are obviously unserious, incomplete, or contrary to the purpose of the Pletix d.o.o. webshop, offers associated with the commission or facilitation of criminal activities, or similar.
3.2.2. Due to such deletions, neither the member nor any third party may exercise any rights or make any claims against Pletix d.o.o.
3.2.3. The Pletix d.o.o. webshop also reserves the right, without prior notice and without explanation, to rename, split, merge, delete, reestablish, or otherwise modify the offered category, as well as to move an existing offer from one relevant category to another.
3.2.4. Pletix d.o.o. reserves the right to delete such offers without prior notice.

4. DELIVERY

4.1. On the Pletix d.o.o. webshop, delivery from the Seller to the Buyer is carried out by a delivery service selected by Pletix d.o.o. across the entire territory of Croatia.
4.2. At the moment when the buyer finalizes the order on the Pletix d.o.o. webshop, they receive a notification and an invoice via email.
4.3. Products must be adequately packaged for transportation.
4.4. Adequate packaging of the shipment means placing the contents of the shipment in appropriate packaging (wrapping, box, case, etc.) to prevent damage or reduction of its contents or the contents of other shipments during transportation.
4.5. Packaging must be appropriate for the content and shape of the shipment, its size, weight, and value, as well as the conditions and length of the route on which it is transported.

5. COMPLAINTS

5.1. In accordance with Article 10 of the Consumer Protection Act (Official Gazette No. 41/14), the buyer has the right to file a consumer complaint or return products purchased through the PLETIX.hr webshop within the legal period. The complaint/return form is available HERE.

5.2. Complaints or returns can be made by filling out the form available at the link above and sending it by mail to the address Pletix d.o.o., Kamanje 102, 47282 Kamanje, or by email to webshop@pletix.hr. Additionally, the right to file a complaint/return can be exercised by sending any other document that describes the consumer’s complaint to the address or email provided in this section.

5.3. A complaint will be considered valid if, after inspecting the product and, if necessary, conducting additional expert analysis, it is determined that it meets the conditions for a complaint in accordance with the Obligations Act and the Consumer Protection Act.

5.4. Pletix d.o.o. is committed to responding in writing to the customer’s complaint within 15 days.

5.5. If it is determined that the complaint is not valid, i.e., if the consumer’s complaint is rejected, the customer who filed the complaint will bear the cost of reshipping the purchased product to the customer’s address.

5.6. If it is determined that the complaint is valid, Pletix d.o.o. commits to replacing the product with an identical one without defects or refunding the full amount paid for the product.

6. REFUND POLICY

6.1. After receiving the goods, the customer can return the received goods to the seller within 14 days under the following conditions:
6.1.1. If the customer returns an unworn, unused product in its original packaging with the original tags attached, the seller will refund the full purchase price paid for the product.
6.1.2. The seller is not obligated to accept a return of a product that has been damaged or used after receipt by the customer, nor is the seller obligated to refund the purchase price paid.
6.1.3. The seller is not obligated to accept a return of a product that does not have all the accompanying documentation that was attached to the product at the time of receipt by the customer, nor is the seller obligated to refund the purchase price paid.
6.2. A refund can only be processed after the goods have been returned to us, within 14 days of the refund approval.
6.3. To exercise the right to unilateral contract termination, the consumer must provide the trader with a written notice stating that the contract is being terminated. The notice must be written on a durable medium and include the details listed below and can be sent as a letter by mail or as an email. The contract termination form is available for download further down in this text.
6.4. The right to unilateral contract termination begins on the date of delivery, i.e., the date the shipment is received.

LIABILITY FOR MATERIAL DEFECTS

Pletix d.o.o. is liable for material defects in products in accordance with the Obligations Act. Pletix d.o.o. is responsible for material defects in goods that existed at the time of the transfer of risk to the Buyer, regardless of whether the Buyer was aware of them. Pletix d.o.o. is also liable for material defects that appear after the transfer of risk to the Buyer if they are caused by a reason that existed before the transfer. It is presumed that a defect appearing within six months of the transfer of risk existed at the time of the transfer unless Pletix d.o.o. proves otherwise or if the nature of the goods or the defect suggests otherwise. Pletix d.o.o. is not liable for minor material defects.

A MATERIAL DEFECT EXISTS IF:

– The item does not have the necessary properties for regular use or trade,
– The item does not have the necessary properties for special use for which the Buyer acquired it, which was known or should have been known to Pletix d.o.o.,
– The item does not have the properties and characteristics that were explicitly or implicitly agreed upon or prescribed,
– When Pletix d.o.o. delivers an item that does not match the sample or model, unless the sample or model was shown for informational purposes only,
– The item does not have the properties that are typically found in other items of the same kind and that the Buyer could reasonably expect based on the nature of the item, especially considering public statements made by Pletix d.o.o., the manufacturer, and their representatives about the properties of the item (advertisements, labeling, etc.),
– If the Buyer expected certain properties of the item based on statements from the manufacturer or its representative, the defect will not be considered if Pletix d.o.o. was not aware and could not have been aware of these statements, or if these statements were refuted before the contract was concluded, or if they did not influence the Buyer’s decision to enter into the contract.

A defect in the product, if necessary, is proven through expert analysis by authorized institutions or with the help of an authorized court expert. If a defect in the product appears within 6 months from the date of purchase and the seller believes the defect did not exist at that time, the costs of the expert analysis are borne by the seller. If a defect in the product appears after 6 months from the date of purchase but not later than 24 months from the date of purchase, the costs of the expert analysis are borne by either the seller or the buyer, depending on the result of the analysis.

Pletix d.o.o. is not liable for defects if they were known to the Buyer at the time the contract was concluded or if they could not have remained unknown to the Buyer. Pletix d.o.o. is also liable for defects that the Buyer could have easily noticed if it was stated that the item has no defects or that the item has certain properties or characteristics.

NOTIFICATION ON HOW TO SUBMIT A CONSUMER COMPLAINT

In accordance with Article 10 of the Consumer Protection Act (NN no. 41/14.), we inform consumers that any dissatisfaction with a purchased product or service provided can be expressed in writing at our business premises, where we will immediately confirm receipt of the complaint in writing.

Delivery Conditions:
We will deliver the ordered goods to your chosen address via express delivery within 5 business days from the moment we confirm the availability of the ordered items, unless the delivery service has a specified schedule that applies to your address. Delivery costs within the Republic of Croatia are not charged if your order exceeds a total amount of 500.00 HRK. For orders less than 500.00 HRK, the delivery cost is 35.00 HRK.

Payment Conditions:
You can pay for the ordered goods by cash on delivery, general payment slip (virman), or credit card.

CASH ON DELIVERY
If you have chosen cash on delivery, after receiving and confirming your order, we will dispatch the shipment to your contact address. Upon receiving the shipment from the delivery person, you must pay the cash on delivery amount equal to the value of the ordered items including VAT + the delivery cost. International delivery does not support cash on delivery.

PAYMENT BY GENERAL PAYMENT SLIP OR ONLINE BANKING
The customer is required to make the payment via a general payment slip or online banking within 24 hours from the moment of the order, and we will dispatch the order after the bank processes the transaction. The payment reference number should include the order number, and payment should be made to IBAN HR1024020061100551275 held at Erste Bank.

PAYMENT BY VIRMAN (COMPANIES)
After placing the order, within 24 hours, we will send you an offer via the email address you provided at the time of the order. You must pay for the ordered goods according to the offer within 24 hours, and upon receipt of the payment, the ordered goods will be sent to your address.

PAYMENT BY CREDIT CARDS
Payment by credit cards is possible as a one-time payment or installment (American Express, Diners, Mastercard) for amounts over 500 HRK. On the T-com Pay Way page, select the type of credit card you are using and enter the requested details. Once you confirm the purchase, you will see a confirmation of your order which will be sent to your email address. We use a credit card pre-authorization system: until we verify that the ordered product is available, the transaction will not be completed, but the funds on your card will be “reserved” until confirmation or cancellation of the transaction. The T-com Pay Way system will send you a confirmation email about the authorization of your card for the specified amount. For your protection, the Pay Way system does not allow us to charge more than the authorized amount or view your credit card number.

SECURITY OF PAYMENT
For the authorization and processing of credit card payments, we use T-Com Pay Way. T-Com Pay Way applies the latest standards in protecting your data – Secure Socket Layer (SSL) encryption.

The ISO 8583 protocol ensures that the exchange of sensitive data between T-Com internet and the card issuer’s authorization centers takes place in a private network protected from unauthorized access by a dual firewall layer. For MasterCard and Visa cards, the 3D Secure program for secure purchases is applied. Credit card numbers are not stored and are not accessible to unauthorized persons.

You can become a customer if you are of legal age, over 18 years old, and accept our terms of use, general business terms, and purchase conditions which are available immediately before completing the purchase.

A customer is any person who electronically orders a product.

A customer is any legal or natural person who orders product(s) by accepting the offer issued in electronic or written form and makes full payment as required in the offer.

A customer is not a person who only requests an informational offer via the Pletix.hr website.

The prices displayed in the online store are retail prices and are expressed in the Croatian currency, kuna.

The purchase process must be completed in full.

By ordering products through the Pletix d.o.o. online store, you accept the purchase conditions stated on the online store.

Pletix d.o.o. undertakes to operate in accordance with the laws of the Republic of Croatia.

Pletix d.o.o. reserves the right not to process and deliver products to the customer if the credit/debit card is invalid or cannot be authorized.

Pletix d.o.o. reserves the right not to process and deliver products to the customer if there is a suspicion of fraud, in which case the customer will be notified by email or telephone call.

Pletix d.o.o. reserves the right not to process and deliver products to the customer if it is not possible to contact the customer.

Pletix d.o.o. reserves the right not to process and deliver products to the customer if the address is non-existent or the product cannot be delivered to the given address.

Pletix d.o.o. is not liable for any damage caused by the non-fulfillment of the order.

If delivery of the selected product by Pletix d.o.o. becomes impossible because the product is not in stock or cannot be ordered from the supplier, we are obliged to notify the customer in writing. The customer may then decide:

– Whether to cancel the order, in which case neither payment nor delivery will be processed;
– To accept a new delivery time if the product can be ordered from the supplier, and we must inform the customer of the expected delivery time;
– If we cannot order an identical product from the supplier under the same conditions, we may offer the customer a substitute product with similar characteristics at the current price for that product.

The official language of communication on Pletix.hr is Croatian.

PRICES

Prices are expressed in kuna (HRK) and include VAT.

The price of goods is determined for each product individually. The process of entering the price on the page for each product is subject to multiple levels of control; however, there is a possibility of error due to human factors, as this is not an automatic entry process.

Such situations are exceptional, and Pletix d.o.o. apologizes in advance to its customers as it will be forced to inform them of the situation, the incorrect price for a particular product, and the inability to deliver the specific order.

SALE

Pletix d.o.o. will periodically place certain products on sale at its discretion.

These products will be available under the same conditions to all customers or will be available to customers of a specific, precisely defined group. The terms of the sale will be detailed, including the duration of the sale, quantity limits, discount levels, etc.

After the sale period expires, Pletix d.o.o. will not accept new orders under the conditions of the sale that has ended.

Due to the large number of orders being submitted simultaneously on the Pletix d.o.o. webshop, there may be discrepancies between the product availability information and the stock status of Pletix d.o.o. Such situations are exceptional and short-lived.

Pletix d.o.o. will take all necessary measures and engage all possible resources to deliver the ordered product within a reasonable time. If Pletix d.o.o. does not have the ordered product available, it will notify you by email (which you provided as the contact email) and offer you the possibility to purchase any other product from the Pletix d.o.o. webshop that is available for delivery and is closest in characteristics to the undeliverable product. Pletix d.o.o. disclaims responsibility for the consequences of the described situation.

Your order is considered confirmed and valid only when an invoice has been created.

Exchanges:
If you are dissatisfied with the product for any reason, you may exchange it for any other product or return it for a refund within 14 days of receipt. To exercise this right, the undamaged product must be sent in its original packaging with all equipment and documentation that came with the product, along with the invoice or other document proving the product was purchased from Pletix d.o.o. Requests for exchanges can be submitted via email to webshop@pletix.hr, specifying the order number, the code or description of the item you wish to exchange, and the details of the item (code or description) for which you wish to exchange the previously ordered product.

The first exchange is free of charge. For the first exchange, we will arrange delivery service to your address at our expense. For each subsequent exchange of the same order or item, the shipping costs are borne by the sender, i.e., the customer.

If the shipment is damaged during transport, such damage will be visible upon receipt of the shipment. In such cases, please do not accept the shipment but contact us so we can verify the condition of the shipment and, if necessary, send a replacement as soon as possible.

Contract Cancellation:
In accordance with the Consumer Protection Act, you are entitled to unilaterally cancel the purchase agreement with Pletix d.o.o. without providing reasons within 14 days from the date of delivery of the product or the delivery of the last product from the order.

Returns can be made by filling out the Form available at the link above and sending it via email to webshop@pletix.hr. After receiving the email, our customer service will provide you with the address to which the package should be sent, and once the package arrives at our sales location, we will process the refund.

Return shipping costs are borne by the sender, i.e., the customer.

The refund will be made using the same method you used for payment, except in the case of cash on delivery, when the money will be returned to the bank account you specify for the refund.

To exercise this right, the undamaged product must be sent in its original packaging with all equipment and documentation that came with the product, along with the invoice or other document proving the product was purchased from Pletix d.o.o.

For goods picked up at the chosen sales location, returns can be made to the desired sales location.

To exercise this right, a request must be sent via email to webshop@pletix.hr, and the undamaged product must be brought to the desired sales location with all equipment and documentation that came with the product, along with the invoice or other document proving the product was purchased from Pletix d.o.o. A confirmation will be issued at the sales location for the returned item.

When returning an item to the sales location, the refund cannot be processed at the sales location but is exclusively handled through the webshop, i.e., to the account you specified in the request or to the credit card used for the purchase.

In case of contract cancellation, each party is obligated to return to the other what was received under the contract, in accordance with the provisions of the Consumer Protection Act. We will process the refund after the goods are returned to us. You must return the goods without delay and no later than 14 days from the day you notified us of the unilateral contract termination.

Please note that you are responsible for any reduction in the value of the goods resulting from handling the goods, other than what is necessary to ascertain the nature, characteristics, and functionality of the goods. By accepting these general terms, you agree to the provisions of the mentioned regulations.

Consumer Complaints
The customer has the right to file a complaint or claim for products purchased through the Pletix.hr webshop within the statutory period according to the Consumer Protection Act. The complaint/claim form is available below in this text.

The return is processed by our customer service, which will provide the address to which the package should be sent after receiving the email. Once the package arrives at our sales location, we will process the refund. Shipping costs for the returned product are borne by Pletix d.o.o. The complaint will be considered valid if, after examining the product and, if necessary, further expertise, it is found to meet the conditions for a complaint according to the Obligations Act and the Consumer Protection Act.

Pletix d.o.o. is obligated to respond to the complaint or claim in writing within 15 days.

If it is determined that the complaint is not valid, i.e., if the consumer’s complaint is rejected, the customer who filed the complaint will bear the cost of re-delivering the purchased product to the customer’s home address.

If it is determined that the complaint is valid, Pletix d.o.o. is obligated to replace the product with an identical one without defects or to refund the full amount for which the product was purchased.
